MacDonald Judge SEARCH WARRANT TO Detective Jim Byfield, or Agent Charles Davis, or any officer authorized by law to execute search warrants within the County of Boulder, State of Colorado, having this date filed an affidavit for search warrant in conformity with the provisions of Colorado Rules of Criminal Procedure (Rule 41), for the following described property, to-wit: 1. Any data of a sexual nature including adult pornography, adult nudes, child pornography, child nudes and any related correspondence, electronic mail (e-mail), including letters, notes, memorandum, or other communications in written or oral firm, stored on the computer system described below. These material could be stand alone files attached to or contained within the e-mail, and/or possibly stored in the form of data, files, documents, graphics, or fragments or partially deleted fragments of the same, or other magnetically stored format, stored on floppy disks, hard disk drives, magnetic tapes or other media capable of storing information in either a magnetic or optical form. 2. Any and all graphic images stored in various formats, to include both color and black-and-white, as well as sequential frame and full-motion video. These images would be of a sexual nature including adult pornography, adult nudes, child pornography, child nudes. believed to be situated (in or on the items) or (at the place) known as: Computer-Compaq CNT 75MB, 1 Computer disk, NEC Computer Disk, Computer Hard drive, NEC Disk, HyperCard, Computer Book Computer Disk, 8 CD Rom. Computer Disks (Macintosh), Computer Disk with box, 8 Computer Disks (3.5"), 2 CD Roms, 3 Floppy disk's, 2 CD Rom. Computer Disks, 1 Computer Disk, 7 CD Rom. Computer Disks, 2 Computer Disks, 2 Computer Disks, 1 NEC Computer Disk, Nec Computer Disk, CD Rom. Titles Books, Apple guide, Supra Modem Disk, Computer Disk NEC floppy disc, 8 computer Disks (Macintosh), 10 Computer Disks, 1 Computer Disk, 3 Computer Disks, Macintosh Computer; including the Electronic data processing and storage devices, computers and computer systems including central processing units; internal and peripheral storage devices such as fixed disks, external hard disks, floppy disk drives and diskettes, tape drives and tapes, optical storage devices or other memory storage devices included within the items herein described and which were seized from 755 15th St., Boulder, Colorado; and which are currently located and stored at The Colorado Bureau of Investigation at 690 Kipling Street, Denver, County of Jefferson, State of Colorado. Upon one or more of the grounds set forth in Rule 41, Colorado Rules of Criminal Procedure, namely; Certain property which is designed or intended for use or which is or has been used as a means of committing a criminal offense, or the possession of which is illegal, or which would be material evidence in a subsequent criminal prosecution. I am satisfied that there is probable cause to believe that the property so described is located (in or on the items) and (premises) above described. YOU ARE THEREFORE COMMANDED to search forthwith the place or items described fro the property described (during the daytime) (at any time), and to make return of this warrant to the undersigned Judge with ten days thereof, and to deliver to the person from whom the property is taken or from the premises from which the property is taken, a copy of this Warrant together with a receipt for the property taken, or, in lieu thereof, to leave a copy of the Warrant and receipt at the place from which the property is taken, and to deliver to the undersigned Judge a written inventory of the property taken with the return of this Warrant. Diane R MacDonald Signature of Judge AFFIDAVIT FOR SEARCH WARRANT Your Affiant is Jim Byfield, currently assigned to the Detective Division with the Boulder Police Department. Your Affiant has been assigned to the Detective Division for two years and served as a Patrol Officer with the Boulder Police Department since January 5, 1981. After being duly sworn, Your Affiant states the following: Through official police reports and conversations with other members of the Boulder Police Department, including commissioned officers Linda Arndt, Michael Everett, Rick French, Tom Trujillo and Larry Mason. Your Affiant personally learned the following from those officers: On December 26, 1996, at approximately 5:52 a.m., Boulder Police Officers Karl Veitch and Rick French responded to 755 15th St, Boulder, Colorado, regarding a possible kidnapping. The residence of 755 15th St., John and Patsy Ramsey, informed the officers of the following: The Ramsey's reside at 755 15th St., and are the parents of JonBenet Ramsey, who is six years old. This morning at approximately 5:45 a.m., Patsy Ramsey discovered that JonBenet Ramsey was missing from the residence. JonBenet was last seen by Patsy Ramsey in the residence at approximately 10:00 p.m. December 25th. According to Officers French and Veitch there were no obvious signs of forcible entry into their residence and the Ramsey's believed that the house was locked when they went to bed. Your Affiant, through Boulder Regional Communications Center Dispatch, was advised at approximately 1:05 p.m. on December 26th, 1996, that the body of JonBenet Ramsey was discovered in the basement of 755 15th St., Boulder, Boulder County, State of Colorado. Your Affiant personally met with BPD Detective Linda Arndt. Det. Arndt personally provided Your Affiant with the following information: Det. Arndt had been inside the residence located at 755 15th St. Boulder, Boulder County, Colorado from approximately 0800 hours until 1435 hours on December 26, 1996. Det. Arndt had been called out to respond to this residence earlier this morning on the report of the 6 year old female child at this residence who had reportedly been kidnapped. There was no sign of forced entry to this residence. The female child, JonBenet Ramsey, had last been seen by her father, John Ramsey, at approximately 2200 hours on December 25, 1996. This information had personally been told to Det. Arndt by John Ramsey. JonBenet had last been seen in her bed. JonBenet's bedroom is located on the second floor of the residence. According to John Ramsey, the only persons at this residence from approximately 2200 hours on December 25, 1996 until 0545 hours on December 26 were: John Ramsey (father of JonBenet); Patricia "Patsy" Ramsey (mother of JonBenet); and Burke Ramsey (11 year old brother of JonBenet). When Det. Arndt arrived at the Ramsey residence, persons present included: John Ramsey, Patsy Ramsey, Priscilla and Fleet White (friends of the family), Barbara and John Fernie (friends of the family), the pastor from St. John's Episcopalian Church (1400 block in Boulder), BPD officers Rick French and Barry Weiss. Officer French personally told Det. Arndt that the White's and the Fernie's had been phoned by either John or Patsy Ramsey shortly after the note was found and had immediately come over to the Ramsey residence. The pastor also responded to the Ramsey residence shortly after the note was found. Patsy told Det. Arndt that she found a note at the bottom of the staircase leading from the first floor to the second floor. Refer to Attachment A. The note was found at approximately 0545 hours on December 26. Det. Arndt had personally viewed this note. The note was written on white lined paper with a felt type writing utensil with black ink. The note stated that JonBenet had been kidnapped. The note stated that JonBenet would be decapitated if the demands of the note were not met. The note stated that police were not to be contacted. The note stated that $118,000 was demanded as ransom. The author(s) of the note stated that they would phone Mr. John Ramsey "tomorrow" between 0800-1000 hours. Detective Arndt monitored incoming phone calls to the Ramsey residence from approximately 0800 - 1300 hours. John Ramsey answered the incoming phone calls. None of the incoming calls were from the reported kidnappers. At approximately 1300 hours Detective Arndt asked John Ramsey, and his friends Fleet White and John Fernie, to check the interior of the residence for any sign of JonBenet, or anything that may have been left or taken that belonged to JonBenet. JonBenet's bedroom had been sealed off by Detectives Arndt and Fred Patterson at approximately 1030 hours. John Ramsey immediately went to the basement of the house, followed by Fleet White and John Fernie. Within a few minutes, Fleet White came running upstairs, grabbed the telephone in the back office located on the first floor, and yelled for someone to call for an ambulance. Detective Arndt ran to the front of the house, where the door leading to the basement was located. Det. Arndt saw John Ramsey run up the basement stairs. John Ramsey was carrying a young girl in his arms. Both arms of the girl were raised above her head. There appeared to be a string hanging from the girl's right wrist. The girl's lips were blue; she appeared to have livor mortis on her back side of her body; she had rigor mortis; she was not breathing. JonBenet was dressed in a light colored long-sleeved turtleneck and light-colored pants (similar to pajama bottoms). John Ramsey placed the girl onto the floor, inside the front door. The girl was identified by Jon Ramsey as being JonBenet. JonBenet was not breathing; her body was cool to the touch; she had a white cloth string around her neck, similar to the clothe string around her wrist; there was a red circular mark in the front of her neck, about the size of a quarter, at the base of her throat; she had an odor of decay to her; she had dried mucous from one of her nostrils. Based on Det. Arndt's experience, JonBenet appeared to be dead, and appeared to have been dead for a period of time. John Ramsey told Det. Arndt that he had found JonBenet in the wine cellar in the basement, underneath a blanket, with her wrists tied above her head and a piece of tape covering her mouth. John Ramsey had removed the tape from her mouth before he carried JonBenet upstairs to the first floor. Detective Arndt personally told Your Affiant JonBenet's body was left inside the residence. Det. Michael Everett informed Your Affiant that after the discovery of the girl's body that he walked through the basement area of the house to attempt to determine if any persons were present in the basement. In the area where Det. Arndt had told Det. Everett that the decedent had been found by her father he observed two blankets on the floor in the center of the room. Detective Linda Arndt describe, to Your Affiant, the resident at 755 15th St., Boulder Colorado as a multiple story wood frame house with and attached garage which has a brown brick exterior with tan siding and brown and white trim. She said the number "755" appear to the left (south) of the front door, and it is the third house south of Cascade Street on the West side of 15th Street. She added that the front door to the residence faces east, toward 15th Street. Detective Arndt told Your Affiant that she briefly viewed two vehicles parked inside the attached garage of the residence. She told Your Affiant that one of the vehicles was jaguar 4 door and the other vehicle was a utility type vehicle. Detective Arndt also told me that she obtained a Cosin printout of the vehicles listing to John Ramsey. She said the Cosin printout indicated that John Ramsey is the driver of a 1995 Jaguar 4 door with Colorado passenger license #MAN8301, and that he is the driver of a 1996 Jeep utility vehicle with Colorado passenger license #MAH5615. On December 26, 1996, Your Affiant made an application for a search warrant for the premises of 755 15th St., Boulder County, Colorado. The warrant was signed by the Honorable Judge Diane R. MacDonald. Your Affiant was present during the search of the premises of 755 15th St. The search was commenced at approximately 20:20 on December 26, 1996. The body of the deceased was removed by Pat Dunn of the Boulder County Coroners Office, pursuant to the warrant. The child was transported to Boulder Community Hospital. On December 27, 1996 a post mortem examination was conducted by Dr. John Meyer, the Boulder County Coroner. On December 27, 1996, Det. Linda Arndt and Det. Tom Trujillo of the Boulder Police Department were in attendance at the post mortem examination of the body of JonBenet Ramsey examination conducted by Dr. John Meyer. Det. Arndt informed Your Affiant of this, and that the clothing that the child was wearing at the time of Dr. Meyer's post mortem examination was the same clothing that she observed the child to be wearing when the body was initially discovered. At approximately 11:20 hours on December 27, 1996, Det Arndt informed Your Affiant of the following information: Det. Arndt informed Your Affiant that she observed entangled in the hair of the child a green substance. Based upon her observations while at the residence on December 26, 1996, she believed that the green substance observed in the hair of the child was consistent with the green "garland" like decorative Christmas material that she had observed to be decorating the spiral staircase inside the child's home. Det. Arndt stated to Your Affiant that she was present and observed a visual examination by Dr. Meyer of the shirt worn by the child. She observed and Dr. Meyer preserved dark fibers and dark hair found on the outside of the shirt Det. Arndt told Your Affiant that she personally observed Dr. John Meyer examine the vaginal and pubic areas of the deceased, Dr. Meyer stated that he observed numerous traces of a dark fiber. Detective Arndt told Your Affiant that she witnessed the autopsy of JonBenet Ramsey which was conducted by Dr. John Meyer on December 26, 1996. Detective Arndt told Your Affiant that she observed Dr. Meyer examine the vaginal area of the victim and heard him state that the victim had received an injury consistent with digital penetration of her vagina. Detective Arndt told Your Affiant that Dr. Meyer told her that is was his opinion that the victim had been subjected to sexual contact. In the presence of Det. Arndt, Det. Tom Trujillo of the Boulder Police Department, used a black florescent light the view the body including the pubic area of the victim in an attempt to observe the possible presence of semen or seminal fluid. (Your Affiant knows from previous experience and training that substances such as semen or seminal fluid, not visible to the unaided eye, may become visible when viewed under a black florescent light). Det. Arndt stated that she observed florescent areas of the upper inner and outer left thigh, as well as the upper and inner right thigh. Det. Arndt stated that her observations of the result of the black florescent light observation is consistent with the presence of semen or seminal fluid. Det. Arndt informed Your Affiant that she observed Dr. Meyer swab these florescent areas. Dr. Meyer was also observed by Det. Arndt to obtain vaginal, oral and anal swabs from the child's body. (According to examination conducted at the Colorado Bureau of Investigations, no semen was located on the body, panties, or clothing of JonBenet Ramsey). Det. Arndt informed Your Affiant that Dr. Meyer stated to her that he observed red stains in the crotch area of the panties that the child was wearing at the time that the child's body was subjected to the external visual examination. Dr. Meyer stated to Det. Arndt that the red stain appeared to be consistent with blood. Det. Arndt further informed Your Affiant that Dr. Meyer stated to her that after examining the panties (as described above), he observed the exterior pubic area of the child's body located next to the areas of the panties containing the red stains and found no visible reddish stains in the area. Dr. Meyer stated to Det. Arndt that his opinion is that the evidence observed is consistent with the child's public area having been wiped by a cloth. At approximately 14:00 hours on December 27, 1996 Your Affiant was called by Det. Arndt. Detective Arndt stated she was present when Dr. Meyer, as part of the autopsy procedure on JonBenet, examined the skull of the child. Detective Arndt told Your Affiant that Dr. Meyer said that the right side of JonBenet Ramsey's skull had a linear fracture which ran the entire length of the skull, measuring 8.5" in length front to rear. Detective Arndt told me that Dr. Meyer said he observed recent fresh hemorrhage to the brain consistent with the skull fracture line and running its entire length, and that there was a rectangular shaped displaced piece of skull measuring 1.75" x .5". Detective Arndt stated that the placement of bruising and the skull fracture on the same side of the child's skull, in the opinion of Dr. Meyer, was consistent with a blow to the head. On December 27, 1996, Your Affiant applied for a second search warrant for the premises of 755 15th Street, City and County of Boulder, State of Colorado. The Honorable Judge Diane R. MacDonald signed the second warrant. On December 29, 1996, Your Affiant talked to Sergeant Bob Whitson of the Boulder Police Department. Seargeant Witson told Your Affiant that he responded to 755 15th Street, City and County of Boulder, State of Colorado at approximately 0930 hours on December 25, 1996 in response to the report of a kidnapping. Seargeant Whitson told Your Affiant that when he arrived at the Ramsey residence, he entered through the rear exterior kitchen door. He told Your Affiant that as he entered the residence he saw what appeared to be a pry-mark in the door jam of this door. He told Your Affiant that the mark he observed was on the exterior of the house near the door knob and lock on the door, and that the damaged area appeared to have been less weathered than the surrounding surfaces on the door and door jam. Seargeant Whitson told Your Affiant that he spoke to John Ramsey who identified himself as the owner of the residence and the father of JonBenet Ramsey who he reported was now missing. Seargeant Witson told Your Affiant that Jon Ramsey stated to him that all the doors to the residence were locked when he and his family went to bed on the previous evening of December 25, 1996. Seargeant Whitson told Your Affiant that John Ramsey told him that the doors were still locked this morning when they discovered the child was missing. Detective Linda Arndt told Your Affiant that John Ramsey stated to her that his daughter is six years old and that he last saw her at approximately 2200 hours on December 25, 1996. On December 28, 1996 Your Affiant observed that the Ramsey residence has several exterior doors and windows. Your Affiant observed that many of these potential entrances into the house are secured with locks or locking mechanisms. Your Affiant knows from personal experience and training that tools commonly known as lock picks can open locks and locking mechanisms. Your Affiant also knows from his personal experience and training that the use of tools, such as lock picks, can leave marks on the external surfaces or internal workings of a lock. Since all the doors were allegedly locked, an examination of any markings on the internal workings of their locks would provide material evidence in a subsequent criminal prosecution. On December 28, 1996 Your Affiant saw a computer, monitor, mouse, printer, and removable computer storage media. your Affiant saw this equipment in the play room area on the second floor of the Ramsey residence at 755 15 Street, Boulder Colorado. Your Affiant knows that Officer Yamaguchi of the Boulder Police Department was helping in the search of the Ramsey residence. Officer Yamaguchi told Your Affiant that he saw a modem near the computer that was in the play room area of the residence. Officer Yamaguchi told Your Affiant that he saw a manual on Compuserve and Compuserve discs located in the office of the Ramsey residence. Officer Yamaguchi told Your Affiant that he has several years experience in the operation of computers an that he has five years experience as a consultant in the use of computers, software, and the Internet. He further stated that, using his personal computer, he found that John Ramsey in Boulder, Colorado was a subscriber to Compuserve. Officer Yamaguchi told Your Affiant that Compuserve is a company that provides access to the Internet, and that the Internet can be used to view text and images involving child pornography. Officer Yamaguchi stated to Your Affiant that the text or images of child pornography can be collected and saved on the hard drives of computers and on removable computer storage media. He stated to Your Affiant that computers can make electronic records of Internet sites that were recently visited on that computer. With this information, Officer Yamaguchi told Your Affiant that an investigator could determine if the computer was used to view text or images involving child pornography. On December 28, 1996 Your Affiant saw a compact video camera, compact video tapes, and standard size video tapes inside the Ramsey residence at 755 15th Street Boulder, Colorado. You Affiant personally knows that Detective Linda Arndt's duties include the investigation of child sexual assaults and molestations, and that she has attended classes on the investigation of child sexual assault cases. Detective Arndt told Your Affiant that, based on her training and experience, some child molesters keep collections of photographs, computer images, or videos of children. She further stated that they can conceal such videos within commercially labeled video tapes. She further stated to your Affiant that these images may or may not be obviously pornographic in nature. Detective Arndt also told Your Affiant that child molesters have been known to video tape the murder of their victim(s). Your Affiant is aware that Detective Steve Ainsworth of the Boulder County Sheriff's Department was assisting in the processing of the Ramsey residence on December 28, 1996. Detective Ainsworth told Your Affiant that the video inside the compact video camera depicted children washing fruit in the kitchen. He said this tape was dated August of 1996. He also told Your Affiant that there was another compact video tape located next to the compact video camera that is in the kitchen. Officer Yamaguchi told Your Affiant that he saw a standard size Betamax video camera, Betamax video tapes, and Betamax player/recorder in the main floor study of the residence. Your affiant prepared a third search warrant for the search of 755 15th St. Boulder, Boulder County, Colorado was signed by Judge Diane MacDonald on December 19, 1996. Your Affiant was present during the search of the residence, and Your Affiant was assisted in this search by Detectives Barry Hartkopp and Kerry Yamaguchi of the Boulder Police Department. Your Affiant knows from personal observations and review of the property reports made by Detectives Hartkopp and Yamaguchi that the following items were seized from the residence: Computer-Compaq CNT 75MB, 1 Computer desk, NEC Computer Disk, Computer Hard drive, NEC Disk, HyperCard, Computer Book Computer Disk, 8 CD Rom. Computer Disks (Macintosh), Computer Disk with box, 8 Computer Disks (3.5"), 2 CD Roms, 3 Floppy disk's, 2 CD Rom. Computer Disks, 1 Computer Disk, 7 CD Rom. Computer Disks, 2 Computer Disks, 2 Computer Disks, 1 NEC Computer Disk, Nec Computer Disk, CD Rom. Titles books, Apple guide, Supra Modem Disk, Computer Disk NEC floppy disk, 8 computer Disks (Macintosh), 10 Computer Disks, 1 Computer Disk, 3 Computer Disks, Macintosh Computer Seargeant Tom Wickman of the Boulder Police Department told Your Affiant that all of these above described items were taken from the Boulder Police Department property and evidence section and delivered to the Colorado Bureau of Investigation located at 690 Kipling Street, Denver, Colorado. On January 30, 1997, Your Affiant consulted with Charles E. Davis, an agent with the Colorado Bureau of Investigation concerning the use of computers in the commission of crimes including relating to the possession and distribution of child pornography, and sexual molestation of children. Charles E. Davis told Your Affiant the following: Agent Davis is currently employed as the Computer Crime and High Technology Investigator for the Colorado Bureau Investigation, specializing in the investigation of criminal activities where a computer plays a role in the commission of a crime or may hold evidence of a crime. Agent Davis has held this position since February 1995. In his past employment, he has served as the Chief of the Computer Crimes Investigations Branch, United States Air Force Office of Special Investigations (AFOSI), Detachment 402, Lowry Air Force Base, Colorado for three and one half years. Davis has been a computer crime investigator since February 1992 and a criminal investigator since March 1991. Davis has been trained in the techniques of computer crime investigations and data recovery by the Treasury Federal Law Enforcement Training Center, the Colorado Association of Computer Crime Investigators, and the High Technology Criminal Investigators Association, and has attended search and seizure training conferences hosted by the Investigative Operations Center, Computer Crime Investigations Division, AFOSI, Bolling Air Force Base, DC. In addition, Davis holds a Bachelor of Science degree in Computer Science and has over sixteen years in the use and analysis of computer systems and magnetically stored data. In the past six years, Davis has supervised or participated on over seventy-five search warrants and over two hundred and fifty investigations involving computer-stored records and evidence. Many of these cases involved the use of computers and child pornography. Davis has also been involved in the investigations of child molestation cases. Davis informed Your Affiant that conducting a search of a computer system, documenting the search, making evidentiary determination is a lengthy process. It is necessary to determine that no security devices are in place which could cause the destruction of evidence during the search. In some cases it is impossible to even conduct a search without expert technical assistance, and full seizure of all equipment associated with the computer system in question. In the experience of Davis, the relation of computers to crimes of a sexual nature is common. Computer systems are capable of displaying graphic images of a color and resolution equal to or greater than that of photographic media. Current computer technology, available in many retail stores, make it possible for a computer to display images of sequential frame or full-motion video, both of a quality similar to that of video tapes. Computers can also be used to access, collect, record, store and transmit written material. Davis also stated that in the case of child molestations, it is common for the perpetrator to view child pornography (or adult pornography) on computer equipment before the molestation occurs. It is also common for this type of perpetrator to have documents or correspondents describing or otherwise related to child and adult pornography on their computer equipment and computer storage devices or materials. Evidence of this type of use computers can be located by an examination of the computer equipment and computer storage devices or materials involved. In addition, Davis related to Your Affiant that under the provision of the Electronic Communications Privacy Act of 1986 (18 USC 2711 through 2717), law enforcement officers are required to obtain a search warrant before examining any communications stored in an electronic form. Davis stated, an examination of this nature would include, but not be limited to, a search of any and all electronic mail (E-mail) that might contain letters, notes memorandum or other communications in written or oral form, stored in the computer system described previously. In addition such a search will include the examination of E-mail for evidence of any graphic, picture, or textual material that could have been attached to, contained within, or otherwise transmitted via E-mail, and possibly stored in the form of data, files, documents, graphics, or fragments, or partially deleted fragments of the same, or magnetically stored format, stored on floppy disks, hard disk drives, magnetic tapes, or other media capable of storing information in either magnetic or optical form. Specifically included in this examination would be graphic images stored in various formats, to include both color and black-and-white, as well as sequential frame and full-motion video. Charles Davis also provided your affiant with the following additional reasons why an examination must be conducted on the computer equipment and materials previously described in this affidavit: 1. On the Internet, users send E-mail and connect to other systems through several means: E-mail, TELNET, and FTP. E-mail RETURN AND INVENTORY COUNTY OF BOULDER STATE OF COLORADO I, James R. Byfield, received the within Search Warrant on January 30, 1997, and duly executed it as follows: On Jan. 30 thru Feb. 5, 1997, at 12:10 o'clock p.m., I searched the computers described in the search warrant and left a copy of the search warrant with Bryan Morgan together with an inventory of the property. The following is an inventory of property taken pursuant to the search warrant:
