Peterson's attorney, Joel Brodsky, has denied there was such a gun. Brodsky mocked Ric Mims, a former friend of Peterson's, in March on CNN's "Nancy Grace" show after Mims said that Peterson showed him the gun, saying, "Hey [the police] didn't find this one." Mims said Peterson was "chuckling" when he showed him the gun. On the show, Brodsky called the claim "simply another fabrication of slick Ric Mims." 07/17/2008 Drew Peterson's lawyers end effort to block wrongful-death suit in Savio case" "Lawyers representing the estate of Drew Peterson's third wife are now free to file a wrongful-death lawsuit against Peterson after his attorneys withdrew a motion Thursday that sought to block them. But attorneys for Kathleen Savio's estate said that a wrongful-death lawsuit against the former Bolingbrook police sergeant likely won't be initiated until after the grand jury investigating Savio's death was discharged. "That's something we'll have to look at," said John Q. Kelly, a New York attorney representing the Savio family. Kelly was the lawyer for Nicole Brown Simpson's family in a successful civil suit against O.J. Simpson. "We still have to wait for some finality from the current grand jury investigation," Kelly said." "Peterson mocked investigators as “idiots,” called his third wife “a bitch” whose body he should have had cremated and predicted he’d be tried and acquitted long before his fourth wife’s remains were found, Wawczak said. As the investigation escalated, Peterson took to spending more and more evenings at Wawczak and Stark’s Bolingbrook home, the couple said. He would sneak out his back door, crawl through the yard and jump into their waiting van. “He didn’t know if they were coming for him, and he thought this would be a good place to hide,” Wawczak said." How did you guys met, how close were you? - DREW PETERSON: Oh I've known Lenny for many years, maybe as long as sixteen, maybe twenty years, ah, I was a policeman for many years and on many occasions I was involved in Lenny's arrest, you know for nonsense things going on in town, you know simple batteries and drunken disorderly type things. MIKE: Let's talk abut the nonsense being thrown back and forth in the parking lot, are you have sex with Len's wife? - DREW PETERSON: It's not something were going to talk about today I think. - JULIET: Why? - JOEL BRODSKY Ah, it's just not relevant, ah, we're not going to get involved in that. MIKE: Well you also say Drew that you say to them, Lenny and Paula, ah I wish you guys would go burn down the memorial to Stacy. Respond to that? DREW PETERSON: No, that's something Lenny probably said because I remember I was standing out in front of the house and we were shaking our heads at the shrine they have in front of Sharon's house and I believe Lenny made that comment about burning down the little shrine they have there but that wasn't something that was said by me. JULIET: Do you ever joke around about the death of your third wife or your missing fourth wife? DREW PETERSON: Never ever, these are pretty serious issues, nothing I would joke about. MIKE: Did Len and Paula hide one of your guns from the Illinois State Police? DREW PETERSON: Oh that's something that never really actually happened. What happened was I found out that the State Police was ah, for no particular reason revoking my gun card and I still had a gun that they missed when they did the search warrant so I had to get rid of it and Paula and Lenny were over and Paula had a gun card so I simply made a legal transfer to Paula for that gun so....

Yeah because the thing of it is, I can tell you this much, my last conversation was from somebody from the Illinois State Police Department and that was today. - LILIA CHACON: Why do you think they want you to leak these damaging information? - LENNY WAWCZAK: "Probably to rattle his cage at which it is indeed working." "After the court hearing, Brodsky produced documents for reporters that he said came from the Bolingbrook Police Department proving that it knew Peterson had the gun.' "A Bolingbrook police spokesman, Lt. Ken Teppel, acknowledged there was a department document saying Peterson had a personal assault rifle as a secondary weapon. While Peterson had qualified to shoot the gun in 2005 or 2006 at a training session, he had never received permission from the police chief to carry it on duty, Teppel said. He also questioned whether the weapon had been modified at the time of the training. At the news conference, Brodsky said the length of the barrel at the training session was irrelevant."

The state can now proceed in its criminal case against Peterson, which alleges Peterson owned an AR-15 assault rifle that was too short under state law and that Peterson also illegally transferred the weapon to his son, Steve. Judge Richard Schoenstedt said the defense had not met its legal burden in proving the state’s case was insufficient. “For the defense to be successful at this stage, this court would be required to make certain assumptions on behalf of the defense, and against the state as to the intent and meaning of (the Law Enforcement Officer Safety Act),” Schoenstedt said. “Given the burden described, this court declines to do so.” "Will County State’s Attorney’s office spokesman Charles Pelkie said he was pleased the state can now move forward with the charges. Schoenstedt set a pre-trial hearing for Aug. 28." "Meanwhile, Brodsky said although the decision was a setback, he was pleased by the judge’s agreement that LEOSA applies to the case and that Peterson was covered by the law’s intent to protect officer’s from conceal and carry laws. But Schoenstedt declined to grant the defense’s argument that the law also protected him from possession laws. The defense also demanded a speedy trail, which means a trial would have to being within 160 days."

Jennifer Schoon, the former girlfriend of Drew Peterson’s son Steve testified before the grand jury Thursday. Schoon and her attorney Thomas Glasgow exited the Will County Court Annex building at about 12:45 p.m." “(Schoon) was the girlfriend of Steve Peterson and lived in the house with Drew Peterson and Steve Peterson during the time that Kathleen Savio’s body was discovered,” Glasgow said. Glasgow said Schoon testified extensively but declined to comment on the content of the testimony."
