ILL | 02/01/2008 (chicagotribune.com) "Drew Peterson brings in expert in bid to get items back" "Drew Peterson and his attorney hired a former Michigan State Police forensic scientist to argue Friday before a Will County judge that there has been ample time for Peterson's seized vehicles, guns and other items to be analyzed and that they should be returned. Ann Chamberlain, now with Speckin Forensic Laboratories, told Judge Richard Schoenstedt that evidence technicians generally need only days to process automobiles, guns and computers and that returning them should not hamper the investigation into Peterson's wife's disappearance. At issue is a motion filed in December by Peterson's attorney, Joel Brodsky, asking that the court order police to return two vehicles, 11 guns, computers and other items seized as part of a search warrant." "Assistant State's Atty. John Connor countered that the law does not require officials to continually explain their reasons for keeping items seized via search warrant. He cautioned that if Schoenstedt orders the items returned, "every defendant will be in here trying to get their stuff back." The petition to reopen the estate of the third wife, Kathleen Savio, also alludes to an impending wrongful-death lawsuit against Peterson. "If it flies from here, that's the direction we'll go," said Savio's sister, Anna Marie Doman. And one of the lawyers who helped win a $33.5 million wrongful death judgment against O.J. It was I who photographed the infamous blue barrel in the Illinois River last October. When this tragedy first broke, I felt I wanted to do something to help and contacted AccuSearch who put me in touch with Ric. Every time, I flew around the Bolingbrook countryside, I took numerous aerial photographs. Using GPS technology I was able to put them up on a Google map so people could have an opportunity to see the Bolingbrook area and areas of specific interest to this case. I encourage you to visit and take a look of some very interesting photographs. JB: The problem is that the statute of limitations has run out. GVS: I would argue for the plaintiffs that your client hid the truth about KS's death and the clock on the statute does not begin to run until the wrongful means is discovered. JB: The family was aware that there was suspicion months after KS died. DP is spending more and more time with his children - made a trip to Wisconsin last week. He's starting to enjoy his retirement. His wife left so there's on reason DP can't enjoy a social life. GVS: Do you believe this mother would take off and leave her children. JB: You and I both know, being in the legal business, that mothers do horrible things, even kill their children. Even SP's mother abandoned her family. GVS: What do you think about the claim about KS? JB: She had a heart defect. She had thickening of the mitral valve and she was not a healthy young woman. I expect this case will eventually go away. If he is convicted of murder there is no statute of limitations on the wrongful death, so I believe this is legal malpractice to bring this action now. They should wait to see if DP goes to trial first so they don't lose their cause of action. |

Attorney Martin Glink filed notice in Will County Circuit Court on behalf of Henry J. Savio and Susan Doman. Their motion would be a petition to reopen the case and a response to a Jan. 31 petition by Kathleen Savio's sister and brother, Anna Doman and Henry M. Savio, which sought to block the father from being named executor of the estate.
