She said her 2 teens were driving down that frontage road about midnight and a black pick up was blocking the road. As they went to pass it, a man ran around the truck and got into the passenger side. That was approximately 3 hours before the incident occurred. Later on the news, they showed an arial view of the scene and this womans kids said the black pick up shown as the "passer by" that helped Chris was the same truck they saw at midnight. I also hear that they established a connection between Chris and the passerby, but I was reluctant to share because I dont know where that info came from. It also cited a 1998 U.S. Supreme Court case, which determined that the only issues to be considered while fighting extradition were whether the charging documents were properly drafted, whether the right "fugitive" was arrested and whether the fugitive was charged with a crime in the state seeking extradition. "The commands of the extradition clause are mandatory, and afford no discretion to the executive officer or the courts of the asylum state," according to the U.S. Supreme Court ruling. That makes the extradition case "fatally defective," he said, making it necessary to require Illinois State Police Sgt. Gary Lawson explain why he signed the murder complaint. "Those documents must comply with our statute," Waltrip said. But St. Charles County Prosecuting Attorney Jack Banas said Vaughn’s defense team can’t dig into the Illinois charges as part of the extradition case. All Missouri courts can look at is whether or not the extradition papers are in order and the right man has been arrested, he said. He said Illinois has clearly identified Vaughn as the man charged with murder and that governors of both states have signed extradition orders."
